1. Terms and Conditions

The term “we/us” when used in this text indicates Tosingraf Srl; the term “you” indicates you, the customer. These Terms and Conditions together with your Confirmation of Order constitute the contract between us and you, for the supply of the Products. The contract is formed when Tosingraf srl accepts all or part of your order, or when we send you the Order Confirmation. By placing an order, you confirm that you have read all the instructions given during the purchasing process, and also that you fully accept the following conditions. No other term or condition will be recognised. The Contract may only be amended in the form of a written agreement sent by certified e-mail.

Please print out or save a digital copy of these Terms and Conditions of sale (Articles 3 and 4 of Legislative Decree 185/1999 on e-commerce).

Tosingraf declines all liability for any direct or indirect loss, damage or injury to persons and/or property that may be caused by the non-acceptance of all or part of an order.

2. Placing an Order

2.1 You can place an Order by completing the online Order Form, after having requested and obtained a personal account, if you don’t already have one. Orders not placed via the online form will not be accepted. Customers can only purchase the products contained in the e-catalogue, which is available online at: www.tosingraf.eu. Please note that the images in the product description sheets may not be a completely accurate representation of the characteristics which may vary slightly in terms of colour, size or accessories.

2.2 By placing an Order, you are making an offer to buy the Products you have chosen, on the basis of these Terms and Conditions. We are free to accept or reject your offer.

2.3 If we accept an Order, we will confirm receipt by sending an e-mail to the address provided by the Customer. The confirmation e-mail will contain a Customer Order Number: please quote that number in all further communications with Tosingraf. The e-mail will contain all the details you have entered. Please check the details and notify us immediately of any corrections that may be required, using the procedure indicated in this document.

2.4 If the Order is not accepted, we will promptly inform you.

2.5 If we are unable to deliver the Products you have ordered, our liability is limited only to the restitution of any sums already paid by you.

3. Prices

3.1 The Price for the Products is that indicated in the Invoice.

3.2 Where applicable, any delivery costs will be indicated in the Invoice.

4. Payment

The Products you have purchased may be paid for using the procedure indicated from time to time in the payments section on the website. Payments must be made in a legally-recognised currency, as indicated in the Invoice.

5. Terms of delivery

5.1 For each order placed, Tosingraf will issue an invoice for the shipped material. The invoice will be sent by e-mail to the person who placed the order, in accordance with Article 14 of Presidential Decree 445/2000 and Decree Law 52/2004. The details given by the Customer when placing the order will be used for the purposes of issuing the invoice. The invoice cannot be changed after it has been issued.

5.2 The costs of delivery are indicated in the Invoice. The Customer will pay for the goods using the payment method selected when placing the order.

5.3 Tosingraf declines all responsibility for any delay in the fulfilment of the order or in the delivery of the Products.

5.4 Deliveries will be made at street level, subject to: • any notification to the contrary from our customer service team • the contents of the product technical sheet • a specific request to deliver to a particular floor of the building.

5.5 When the courier delivers the goods, the Customer must check that the packaging is intact and undamaged, that it is not wet/soaked or otherwise impaired and that there is no damage to the adhesive tape or metal strapping.

5.6 If the packaging or products are damaged, if the number of boxes does not correspond to the order or if there are any other discrepancies, you must immediately write a reservation on the courier's delivery note, indicating the reason (e.g. “Broken box”, “Crushed packaging”, etc). After signing the courier delivery note, the Customer may no longer make any complaint about the exterior of the packaging.

5.7 Any issues with the physical integrity, conformity or completeness of the Products must be reported within 8 days of delivery, according to the procedure indicated in this document.
